Senior Commercial Counsel
Job Description:
A specialty biopharmaceutical company with a pipeline advancing toward commercial launch is seeking a Senior Commercial Counsel to serve as a core legal partner as the organization transitions into its commercial phase. Reporting to the General Counsel with a dotted line to the COO, this role is embedded across commercial, medical affairs, regulatory, and clinical development functions.
Responsibilities
Serve as day-to-day strategic legal counsel covering the full product lifecycle from late-stage development through launch and commercialization. Responsibilities include advising on healthcare regulatory matters (labeling, advertising and promotion, payer engagement, drug safety, scientific exchange, and HCP/patient interactions), reviewing and approving branded and unbranded materials through the MLR committee, negotiating and drafting market access and customer-facing contracts (PBM, GPO, wholesaler, rebate/discount, specialty pharmacy), drafting and negotiating MSAs, quality agreements, payer contracts, and clinical trial agreements, advising on federal and state healthcare laws including the FDCA, AKS, FCA, and HIPAA, conducting risk assessments and offering practical solutions that balance legal exposure with business objectives, and supporting the broader regulatory and legal team on an ad hoc basis.
Requirements
· Education: JD with strong credentials and active bar admission in any state (NJ preferred).
· At least 5 years of pharmaceutical/healthcare legal experience either at a nationally recognized law firm or in-house at a biotech or pharma company.
· Prior experience as a product, or brand, attorney in the pharma or biotech space is strongly preferred.
· Comfort operating in a fast-moving, hands-on environment where priorities shift.
· Location: Princeton NJ. Hybrid: 3 days on site.
· Up to 20% travel.
Compensation: Annual Salary Range: $250,000.00 – $325,000.00
The salary offered will be commensurate with experience, skills, qualifications, and other relevant factors.
